No Exhaust Valve Set CEL / MIL?

As I continue to decide on the exhaust I will choose to install, I've narrowed down my options to three somewhat different exhausts. Of these options is the Remark Sport Touring (with two tips and no valve). If I unplug and remove the OEM valve with my OEM exhaust, will I experience any issues setting a CEL / MIL (going into limp mode, etc)? I know AWE offers a similar solution but, they have some sort of plug that goes on the remaining harness left in the car. I'm curious if this is only to weather proof the exposed connector or if it simulates the valve?

I was looking (maybe drooling) at the Remark Sport Touring Ti system and found their instructions on-line. Interesting enough, step 2 states:

Without any real world knowledge, this would seem to indicate that any system that removes the valve will not set the CEL / MIL when unplugged. I'm hoping someone can confirm my theory...

Also interesting that Remark's instructions for the same system in Stainless does not have the same note / claim. I can't imagine how a difference in materials would change the statement

It does set a code, but will not cause the check engine light to come on. I had a customer with a Remark exhaust and no valve in for another issue. A dtc was stored but no light on dash.
